A divorce can be a complicated and unpredictable road to travel. When a divorce is contested, at a minimum you have two people that were once in love, now in essence opponents with very different ideas in how the marriage should end. When children are involved, a divorce can become even more complicated.
In many contested divorces, divorce mediation may be entered voluntarily, and sometimes ordered by the family law court. In Divorce mediation, there will be a Mediator, both divorcing spouses, and their respective attorneys. The family Law Judge is not present and takes no part in the mediation process. Mediation provides both parties, along with their attorneys to try attempt to negotiate reasonable resolutions to issues that are being contested in the divorce.
In every step of the way, your Divorce Lawyer will represent your goals and interests, and make arguments on your behalf to show the Divorce Court Judge that your position is both sound and reasonable. When children are involved the goal is to show that your position is what is in the best interest of the child (or children).
Uncontested Divorce: an uncontested divorce (collaborative divorce) is a much easier process. In an Uncontested Divorce, both spouses are willing to work out the details of the divorce or already agree on the conditions of the divorce. Divorce mediation may also be used in an Uncontested Divorce. Even though an Uncontested Divorce is much easier, takes less time to complete, and may cost significantly less than a contested divorce, the divorce is not final until the Family Law Court Judge signs his or her name to the divorce decree, approving the Divorce.
