Irrevocable Trusts are used when family members want to have their property automatically passed outside of probate two parties they choose to be the beneficiaries of that property, or next of kin.
Irrevocable Trusts are typically used when a person does not want their property to pass that operation of statute. This means if they want certain beneficiaries or family members to be entitled to certain properties they own, the owner of the property can make these designations in the trust, including specifically what property and percentage of the property that beneficiaries will receive.
If there is no trust and there is no will, Florida statutes dictate who your property goes to. Therefore, an Irrevocable Trust can be extremely important. You can ensure you are able to designate your chosen beneficiaries, and make your wishes known as to how your estate, property, and other assets will be distributed.
