A Living Will is a legal document which declares a person's wishes regarding the receipt of:
The Living Will is a Declaration meant to be honored by a person's family and physicians as potentially the final expression of a person's legal right to refuse any additional health care provided that specific conditions are met.
Unlike a "Do Not Resuscitate Order" (DNR), a Living Will may only be implemented if a person is in a permanently unconscious state. A "permanently unconscious state" is defined as an irreversible condition in which a person is permanently unaware of his or herself and his or her surroundings. The person must be examined by at least two different physicians, and both must agree that a total loss of higher brain function exists and that the patient is unable to feel pain or suffering.
A healthcare power of attorney gives a healthcare provider the name and contact information of the person that an individual has designated to have authority to make decisions for them if he or she is unable to consent to health care treatment decisions. Unlike Living Will, Healthcare Powers of Attorney are not only used when the passing of a person is imminent. A Healthcare Power of Attorney may be especially important for the elderly or anyone with a disease or condition that might limit his or her ability to communicate with their healthcare providers. Medical care providers often request these documents, so they may be certain that the patient's choices for healthcare are being met.
A Healthcare Power of Attorney and Living Will are important tools to aid a person's loved ones in ensuring person's intentions are followed when the time comes. All too often, by the time the need for these documents arises, it is too late. Having an up to date Healthcare Power of Attorney and Living Will can provide a person and his or her family comfort in knowing that when the time comes medical treatment will be provided in the manner that a person has consciously chosen.
