PARENTING PLAN

In 2009, the Florida State Legislature passed new legislation that took issues such as child custody, visitation, child support, and other related issues relating to children and divorce and family law issues and combined them into what is known as a “Parenting Plan.”

Prior to this new legislation, each child-related divorce and family law issue had a separate court order. A parenting plan also did away with common well-known terms and replaced them with new socially acceptable terms. Gone are terms such as Child Custody, Joint Custody, Custodial Parent, and Non-Custodial Parent, and Visitation. Contained within a Parenting Plan are new terms such as Primary Residential Parent, Shared Parenting, and Time-sharing. The term Child Support remains.

While the terms have changed, the issues, decisions that need to be made or negotiated, and rulings are generally the same. Who the child (or children) will primarily reside with must still be resolved, just as a time-sharing (visitation) schedule must be determined. Child support will be established, and any other issues relating to the child (children) will still need to be worked out.

Instead of separate documents for each of these child-related issues, each of these issues, are addressed in a Parenting Plan, and included in this one document.

If it is necessary to modify the parenting plan, the parts of the documentation of the Parenting Plan related to the issue in question is updated, and a new Parenting Plan will take effect.
